1. Purpose
This Acceptable Use Policy ("AUP") defines the standards of acceptable conduct for all Users of the Avely Platform, including buyers, sellers, and any other individuals accessing or using the Services. The AUP is designed to maintain a safe, lawful, and trustworthy marketplace for all participants.
This AUP forms part of, and must be read alongside, Avely's Terms of Service, Seller Agreement, and Privacy Policy. Violation of this AUP may result in content removal, account suspension, permanent account termination, and where required, reporting to relevant law enforcement authorities.
2. General Standards of Conduct
All Users must:
- Act honestly and in good faith in all interactions on the Platform;
- Comply with all applicable laws and regulations, including Israeli law and the laws of any jurisdiction in which they operate;
- Respect the rights of other Users, including their intellectual property rights, privacy rights, and consumer rights;
- Use the Platform only for its intended purpose — the lawful sale and purchase of fashion items.
3. Prohibited Content — Listings and Product Descriptions
3.1 Counterfeit and Replica Goods
You may not list, offer for sale, or sell:
- Any item that bears a brand name, logo, trademark, or other identifying mark of a third party that has not authorised the manufacture or sale of the item;
- Any item described as a "replica," "inspired by," "lookalike," or similar language intended to suggest resemblance to a branded item;
- Any item where the seller cannot demonstrate lawful title and a legitimate supply chain.
Avely operates a zero-tolerance policy for counterfeit goods. Listings containing counterfeit items will be removed immediately. Sellers found listing counterfeit goods will face immediate account termination and may be reported to relevant brand protection authorities.
3.2 Stolen Property
You may not list, offer, or sell any item that was obtained through theft, fraud, deception, or any other unlawful means.
3.3 Regulated or Restricted Items
You may not list or sell items that require a licence, permit, or regulatory approval that you do not hold; are subject to an active product safety recall; contain hazardous or toxic materials not compliant with applicable safety standards; or are subject to trade embargoes, sanctions, or export restrictions.
3.4 Weapons and Dangerous Items
You may not list weapons, ammunition, or items designed or primarily intended to cause physical harm to people or animals.
3.5 Adult and Obscene Content
You may not submit photographs, descriptions, or any other content that is sexually explicit, obscene, pornographic in nature, or harassing, threatening, or degrading toward any individual or group.
3.6 Misleading and Deceptive Listings
You may not use false, misleading, or deceptive product descriptions, titles, or photographs; inflate perceived product value through false claims; misrepresent product condition, dimensions, materials, or characteristics; or use keywords in listings designed to mislead search results.
4. Copyright and Intellectual Property
4.1 User Responsibility
All content submitted to the Platform must be either original content created by you, or content for which you have obtained explicit, valid, and sufficient licensing rights. You may not submit content that infringes any third-party copyright, trademark, trade dress, patent, trade secret, or other intellectual property right.
4.2 Brand Names and Trademarks
You may reference a brand name in a product listing only when you are selling a genuine product manufactured by that brand, the reference is factually accurate and non-misleading, and the reference does not imply endorsement, sponsorship, or affiliation with the brand that does not exist.
4.3 Prohibited Trademark Use
You may not use a third party's trademark in a manner likely to cause confusion as to origin, sponsorship, or affiliation; register a username or store name that incorporates a third-party brand name in a manner that infringes that brand's rights; or use editorial, press, or advertising images belonging to third parties without permission.
4.4 AI-Generated Image Policy
AI-generated model images produced by Avely's technology are the intellectual property of Avely. Users may not download, reproduce, or redistribute AI-generated images for any purpose other than viewing on the Platform; use AI-generated images to misrepresent any product; or attempt to reverse-engineer, extract, or replicate Avely's AI image generation system.
4.5 Copyright Infringement Notices
If you believe that content on the Platform infringes your copyright or other intellectual property rights, please submit an infringement notice to: legal@avely.com
Your notice must include: your full name and contact information; a description of the intellectual property right claimed; a description of the allegedly infringing content and its location on the Platform; a statement that you have a good faith belief that the use is unauthorized; and a statement that the information in your notice is accurate and that you are the rights owner or authorized to act on their behalf.
Avely will investigate all valid notices and take appropriate action, which may include content removal. Avely operates a repeat infringer policy and will terminate the accounts of Users who repeatedly infringe intellectual property rights.
5. Abuse Prevention
5.1 Prohibited Platform Manipulation
You may not create fake accounts or duplicate accounts to circumvent bans; manipulate feedback, reviews, or ratings through artificial means; engage in coordinated mass-reporting campaigns against other Users with intent to harm; or use the Platform to artificially inflate listing visibility or manipulate search algorithms.
5.2 Harassment and Harmful Communications
You may not send threatening, abusive, harassing, or discriminatory messages to other Users; use the Platform to stalk, intimidate, or harass any individual; or engage in hate speech or communications that target individuals on the basis of race, ethnicity, religion, gender, sexual orientation, disability, or national origin.
5.3 Spam and Unsolicited Communications
You may not send unsolicited commercial messages or spam to other Users; use buyer contact information for any purpose other than fulfilling the relevant transaction; or distribute malware, phishing links, or any harmful code through the Platform.
5.4 Circumvention of Platform Systems
You may not attempt to conduct transactions outside the Platform to avoid fees; circumvent payment systems, fraud detection, or account verification processes; or attempt to reverse-engineer, decompile, or modify any part of the Platform's technology infrastructure.
5.5 False Impersonation
You may not impersonate Avely, any Avely employee, or any other User of the Platform.
6. Counterfeit Goods — Enforcement Policy
6.1 Listing Removal
Any listing identified as potentially counterfeit will be removed from the Platform pending investigation. Sellers will be notified of the removal.
6.2 Account Suspension
Sellers found to be listing counterfeit goods will have their accounts suspended pending further review. A first-time violation may result in a permanent ban depending on the severity and nature of the listing.
6.3 Reporting to Authorities
Avely cooperates with brand protection authorities, intellectual property rights holders, and law enforcement agencies. Where counterfeiting activity is identified, Avely may share relevant User information with rights holders or law enforcement pursuant to lawful requests and applicable law.
6.4 Brand Protection Program
Avely maintains a brand protection program through which verified intellectual property rights holders may register their rights and request expedited removal of infringing listings. Rights holders may contact: legal@avely.com
7. Reporting Violations
If you identify content or conduct on the Platform that you believe violates this AUP, the Terms of Service, or applicable law, you may report it by using the in-platform "Report" function available on listings and user profiles, or by emailing: trust@avely.com
Avely will review reports in good faith and take appropriate action. We do not guarantee a specific outcome for every report, but we are committed to maintaining a safe and lawful marketplace.
8. Enforcement and Consequences
Avely reserves the right to take any of the following actions in response to violations of this AUP:
- Issue a warning to the User;
- Remove violating content or listings;
- Temporarily suspend User account access;
- Permanently terminate User accounts;
- Withhold or reverse payments from sellers found to have violated this AUP;
- Report conduct to relevant law enforcement or regulatory authorities;
- Pursue civil remedies for damages caused by User violations.
Enforcement decisions are made at Avely's reasonable discretion based on the nature, severity, and recurrence of the violation.
9. Updates to This Policy
This AUP may be updated periodically to reflect changes in platform rules, law, or operational practices. Material changes will be communicated to registered Users. Continued use of the Platform following any update constitutes acceptance of the revised AUP.
